Use of the Services inherently involves sharing your personal information publicly to both Members and non-Members. If you choose to create a personal Member profile on the Site, some of that profile information will be public and could be used by other Users for purposes beyond your control.

Internet search engines could also index your Member profile, making your profile searchable and accessible via the World Wide Web. It is your responsibility to use caution when and if you share any personal or personally identifying information in your Member profile or when communicating with others.

You agree not to include your personal contact information including phone numbers, physical addresses, last names or other personally identifying contact information in your member Profile. If you choose to do so, you do so solely at your own risk. Coffee Tonight accepts no responsibility for any possible consequences or damages resulting from you sharing personally identifying information when using the Site and Services.

YOUR PROFILE
You are limited to creating one Member profile only. Further, you agree that any and all information provided in your profile, including photographs, is accurate, honest and complete.

You agree not to use any information from or about other Members for any reason other than the reason intended or consented to by the originating Member who provided the information. You further agree not to use any Member information for any illegal purposes.

You agree not to solicit or advertise to other Members for any purposes or by any methods.

LOCATION BASED SERVICES
Some of our Services are based upon the physical location of Our Members. If you choose to use these “Location-Based Services”, We may collect and share your geographic and physical location with other Members. If you choose to use these OPTIONAL Location-Based Services you do so at your sole discretion and solely at your own risk.

Coffee Tonight will not be held responsible or liable for any damages or claims that may result directly or indirectly from your choice to share information about your physical location when using these Location-Based Services.

MOBILE BASED SERVICES
Features of the Services may be available via Coffee Tonight Mobile Applications (Apps). These Mobile Apps may be accessed and used via select mobile devices. At the present time, our Mobile Based Services are supported by the Apple iPhone® and Android phones, however this is subject to change at any time and without notification.

If you choose to access or use Our OPTIONAL Mobile Based Services, you do so at your sole discretion and risk. When choosing to access the Mobile Based Services, your mobile carrier’s normal rates apply to your mobile usage as per your mobile rate plan or agreement with your mobile carrier. You are solely responsible for any mobile usage fees that you may incur from your mobile carrier as related to your access to and use of Our Mobile Based Services.

We make no representations, guarantees or warranties as to the availability of the Mobile App(s) nor that they are free of errors. All aspects of this Terms and Conditions of Use Agreement as well as Our Privacy Policy and Disclaimer also apply in full force and effect to your access to and use of the Coffee Tonight Mobile Based Apps. In addition, you may be provided with other specific Terms of Use and Conditions for your review and acceptance when you first access and sign up to use our Mobile Services.

SOCIAL NETWORKING SITE SERVICES
You have the option of accessing and using features of the Services through select Social Networking Sites via proprietary Applications (Apps).

If you choose to access and use the Services via Social Networking Sites, you do so at your sole discretion and risk. As such, you agree to take full responsibility for any possible consequences of your use of Our Social Networking Apps. We make no representations, guarantees or warranties as to the availability of the Social Networking Apps nor that they are free from errors.

When accessing and using the Services via Social Networking Sites, you acknowledge and agree that Coffee Tonight must access and share select information from your Member profile with the Social Networking Sites Applications.

By choosing to ‘Accept’ or ‘Allow’ the use of Our Application(s) on a Social Networking Site, you agree that Coffee Tonight has the right to access your Member profile and account data via any such Social Networking Site to facilitate the use of any such Apps.

Access to and use of your Member profile information via Social Networking Site Applications will be done in accordance with this Terms and Conditions of Use Agreement, our Privacy Policy and Our Disclaimer which remain in full force and effect.

MEMBER INTERACTION
You agree that you take full responsibility for your interactions with other Members – both online and offline.

We make no representations, guarantees or warranties as to the conduct of other Members both online or offline or your compatibility with other Members.

Under no circumstances will Coffee Tonight be held responsible or liable for any damages that may result, directly or indirectly, from the conduct of any Member in connection with the use of these Services. This includes emotional or physical injury that may result from communications or in-person meetings with Members. As such you agree to be careful and take reasonable precautions when you interact with other Members, particularly when meeting in person.

PERSONAL SAFETY AND SECURITY
We currently do not conduct criminal background checks on our members.

We do, however, reserve the right to conduct criminal background checks or other background screenings on any Member at any time and for any reason.

We can in no way make any guarantees as to your safety when contacting or meeting with other Members.

If you believe that you are being harassed or are in danger or if you believe your personal information is being used without your consent for illegal purposes, it is your responsibility to inform your local law enforcement officials. It is also your responsibility to inform us of any such questionable activity associated with the Site or Services so that we may investigate and take necessary action against any Members who may be misusing or abusing the Services.

You should never give your financial information or transfer money to other Members.

You are responsible for educating and protecting yourself against online scams and fraud that may be perpetrated by other Members or unauthorized Users of the Site.

You are also responsible for educating yourself about common sense safety precautions that you should take when meeting people and going on dates. For example, you should always arrange meetings in a safe, public place.

ACCOUNT SECURITY
You agree that you are solely responsible for maintaining the confidentiality and security of your username and password.

You are the only authorized user of your private account and you are responsible for any and all activity on the Site and Services that is accessed via your username and password.

If you suspect that an unauthorized user has gained access to your account or there is any other similar security breach, you agree to notify us immediately.

You agree to use caution when accessing your Member account from public or shared computers. It is also your responsibility to log out of your account at the end of each session.

You further agree that we will not be held liable for any consequences, losses or damages that may result from your failure to comply with these security provisions in this Agreement.

MEMBER CONTENT
Any and all Member-created content on the Site and Services, including but not limited to statements and opinions, do not reflect those of Coffee Tonight and as such We do not endorse or accept responsibility for any Member generated content. Under no circumstances will We be held responsible or liable for any damages or losses resulting from Your reliance on any such Member created content.

EXTERNAL LINKS
The Site and Services may include external links, meaning links that direct Users to other Websites. Websites accessed via External Links from the Coffee Tonight website are independent from Coffee Tonight. Therefore, we are not responsible or liable for the availability, content or services on any sites accessed via the External Links. It is your responsibility to review the Terms of Use, Privacy Policy and Disclaimers on any other websites accessed via External Links from our Site.

COPYRIGHT INFRINGEMENT
We own and retain the rights to all Site Content and Services provided on this Website. This may include material that is protected by copyright, trademarks and other proprietary information. You do not have the right to copy, modify, publish, distribute, display or sell any of the Content on the Site, with the exception of anything that is in the public domain.

TERM AND TERMINATION
Coffee Tonight reserves the right to terminate any Member’s account at any time, for any reason.

You may terminate Your account at anytime, for any reason by following the instructions for termination your Member account and profile in the MY ACCOUNT section of the Site.

Coffee Tonight reserves the right to block any User account or IP address that we deem as a threat to the integrity of the Site and/or Services.

INDEMNITY
You agree to indemnify and hold Coffee Tonight harmless from any liability, claim or loss made by you or any third party in a lawsuit resulting from your actions or breach of this Agreement. In this case, “Coffee Tonight” includes Coffee Tonight’s owners, subsidiaries, affiliates, officers, directors, agents and partners.

DISPUTES
You agree that any and all disputes regarding or in connection with use of the Site and Services will be resolved individually without any resort to class action. Should you violate these Terms and Conditions of Use, Coffee Tonight reserves the right to pursue legal action against you and terminate your account.

ACCEPTANCE

This Agreement constitutes the user agreement between you and Coffee Tonight regarding Your use of Our Site and Services. This Agreement is the governing agreement, superseding any other understanding or agreement between the named parties.
